Remember, this ordinance does not waive CC&Rs and private easements. Enforcement of those restrictions falls on the property owners. Issue
The Coconino County Vacation Rental Owners’ Association has been struggling to regulate short-term rental homes for over a decade. While some owners abide by the CC&Rs, others fail to provide standards for their renters, resulting in conflicts with neighbors. In order to deal with this problem, the Continental Board approached the Homeowners Association with an amendment to limit short-term leases. The amendment would have limited such rentals to 30 days. However, it did not pass by the required 2/3 vote.
In response, Gov. Doug Ducey has passed legislation prohibiting cities from regulating short-term rentals. However, cities still have the authority to restrict the number of such rentals in an area, which is why Mesnard’s bill does not address all of the issues cited by lawmakers. Instead, Mesnard’s bill relies on a principle that applies to all short-term rentals, regardless of whether they are in a residential neighborhood.
